Globally active companies are involved in the discursive construction of moral legitimacy. Establishing normative conformance is problematic given the plurality of norms and values worldwide, and is particularly difficult for companies operating in morally controversial industries. In this paper, we investigate how organizations publicly legitimize the trade of human tissue for private profit when this practice runs counter to deep-seated and widespread moral beliefs. To do so, we use inductive, qualitative methods to analyze the website discourse of three types of (...) organizations that trade in human tissue and are associated with different degrees of moral controversy with respect to tissue procurement and use. Our analysis reveals an object-oriented approach to moral legitimizing centered on the human tissue as a morally disputed good. We find that the website discourse translates human tissue into technology, constructs normative meaning around a dominant instrumental value associated with human-tissue-as-technology, and reproduces and stabilizes this meaning by six discursive mechanisms that amplify and anchor it. Moreover, the use of amplifying and anchoring discourse was greater in organizations associated with greater controversy. The results are consistent with an object-oriented sociality. (shrink)

Everyday there are revelations of organizations behaving in discreditable ways. Sometimes these actions result in damage to an organization's reputation, but often they do not. In this article, we examine the question of why external stakeholders may overlook disclosed discreditable actions, even those entailing ethical breaches. Drawing on stigmatization theory, we develop a model to explain the likelihood of reputational loss following revelations of discreditable actions. The model integrates four properties of actions (perceived control, perceived certainty, perceived threat, and perceived (...) deviance), stakeholder motivation, and media coverage. Implications for theory and for practitioners concerned with reputation management are discussed. (shrink)

Human Rights Education (HRE) has traditionally been articulated in terms of cultivating better citizens or world citizens. The main preoccupation in this strand of HRE has been that of bridging a gap between universal notions of a human rights subject and the actual locality and particular narratives in which students are enmeshed. This preoccupation has focused on ‘learning about the other’ in order to improve relations between plural ‘others’ and ‘us’ and reflects educational aims of national identity politics in citizenship (...) education. The article explores the learning of human rights through narratives in relations, drawing on Hannah Arendt and Sharon Todd. For this re-thinking of relations in learning human rights, the article argues that HRE needs to address both competing historical narratives on the drafting of the Universal Declaration on Human Rights (UDHR) as well as unique life narratives of learners. Bearing witness is a familiar if diversely employed concept. On the one hand, it concerns the accuracy and validity of practical affairs, for example in a court of law, at a wedding, or in a law office. On the other hand, the term can embody powerful religious, social, and/ or moral meaning, whether in bearing witness to historical trauma and human suffering, or in paying heed to everyday, seemingly ordinary aspects of nature and of human life. In this article, we (...) address the question of what renders a witness trustworthy. We characterize ethical and epistemic constituents of witnessing. We examine the work of several exemplary witnesses: W. G. Sebald, Saidiya Hartman, Jonathan Lear, Etty Hillesum, and John Berger alongside Jean Mohr. These sources help us think about the education of a person who aspires to bear witness, whether it be to traumatic events or to quotidian life in educational or other settings. We present criteria of trustworthiness that can support reflection on what we take to be the important place of bearing witness in educational inquiry and practice. (shrink)

This research note argues that political theorists of refuge ought to consider the experiences of refugees after they have received asylum in the Global North. Currently, much of the literature concerning the duties of states towards refugees implicitly adopts a blanket approach, rather than considering how varied identities may affect the remedies available to displaced people. Given the prevalence of racism, xenophobia, and homophobia in the Global North, and the growing norm of dissident persecution in foreign territory, protection is not (...) guaranteed after either territorial or legal admission. This research note considers the case of LGBTQ refugees in order to demonstrate the analytical potential of more inclusive and diverse normative approaches. Taking the origin and extension of harm seriously requires a conceptualization of sanctuary after asylum that accurately reflects the experiences of the displaced. In doing so, questions arise regarding the nature and efficacy of territorial asylum. (shrink)

In September 2012, news broke of a developing drug disaster in the United States. Health authorities had linked a fungal meningitis outbreak to a contaminated steroid made by a company called the New England Compounding Center. The contaminated steroid was a compounded drug that had not been approved by the Food and Drug Administration, differing from three others that had been approved in that it lacked preservatives present in those agents. Factory inspections revealed unsanitary conditions at NECC's drug production facility. (...) By the time the source of the outbreak was identified, an estimated fourteen thousand people had been injected with the drug. As of December 2012, thirty‐nine had died of meningitis, and hundreds more had been diagnosed with meningitis and other drug‐related conditions. Many factors contributed to this disaster. One was a 2002 Supreme Court decision holding that a law prohibiting providers of compounded drugs from promoting their products through advertising and other means impermissibly restricted commercial speech. Merit review of scientific projects involving laboratory animals is a central issue in the current debate over the ethics of animal experimentation. In this essay, I examine several conceptual, regulatory, and practical problems inherent in the merit review process. Contemporary challenges to the existing merit review system and suggestions for reform are also discussed. The essay concludes with comments on legal and political questions relevant to the future of merit assessment.

The history of Canadian parks systems, within the realm of environmental history, has been deeply affected by contemporary social, environmental, and political beliefs. The rhetoric of human domination over nature and the inherent separation of the two was entrenched throughout historical works on Canadian parks in the early to mid- twentieth century. The liberalization of history within the past forty years has served to shift this trend. The inclusion of scientific knowledge in historical research, the limitation of past prejudices and (...) biases concerning nature and humanity, and the questioning of political policies affecting nature have aided in the growth of a body of historical research and interpretation that questions past perceptions of the natural. The historiographical exploration of parks history offers researchers an exciting opportunity to identify historical factors impacting the practice of environmental history while also discerning and encouraging future trends in environmental history. Using recent historical publications on Canadian parks history as examples, this paper seeks to both uncover the historical factors impacting past historical practice and acknowledge the major philosophical and practical shifts in historical practice that have fostered an exciting new body of work in environmental history. In questioning what it means to be human, what it means to be Canadian, and what the relationship between humanity and nature is and can be, increasingly nuanced historical work offers readers and historians new realms of exploration – both philosophically and practically. Law is a critical determinant of health that public health practitioners encounter in everyday practice. Yet most do not receive any formal public health law training. This article discusses tangible opportunities for strengthening the capacity of current and future practitioners to leverage law to advance health equity priorities.

Previous research has suggested that corporate social performance is positively related to firms’ attractiveness as employers. The authors propose and test an alternative model whereby job applicants’ familiarity with employers mediates the relationship between corporate social performance and organizational attractiveness. Applicants’familiarity with firms may serve as a signal of firms’suitability as employers, with more familiar firms considered more attractive. Furthermore, a firm’s overall level of corporate social activity (whether “good deeds” or “ misdeeds”) may contribute directly to firm familiarity and (...) indirectly to attractiveness through familiarity. The authors’ results support this model; firm familiarity completely mediates the relationship between corporate social performance and organizational attractiveness. (shrink)

Phase 1 healthy volunteer clinical trials—which financially compensate subjects in tests of drug toxicity levels and side effects—appear to place pressure on each joint of the moral framework justifying research. In this article, we review concerns about phase 1 trials as they have been framed in the bioethics literature, including undue inducement and coercion, unjust exploitation, and worries about compromised data validity. We then revisit these concerns in light of the lived experiences of serial participants who are income-dependent on phase (...) 1 trials. We show how participant experiences shift attention from discrete exchanges, behaviors, and events in the research enterprise to the ongoing and dynamic patterns of serial participation in which individual decision-making is embedded in collective social and economic conditions and shaped by institutional policies. We argue in particular for the ethical significance of structurally diminished voluntariness, routine powerlessness in setting the terms of exchange, and incentive structures that may promote pharmaceutical interests but encourage phase 1 healthy volunteers to skirt important rules. A digital solution to the problems caused by US military personnel misusing their digital cameras, pixelization (the intentional post-production enlargement of pixels to obscure potentially disturbing content) has become a defining feature of newsmedia visualizations of American military atrocity during the War on Terror. Here, I consider the ethics and politics of pixelizing photographs depicting torture at Abu Ghraib, the exploits of the American ‘Kill Team’ in Afghanistan, and the carnality of US Marines urinating on the corpses of Taliban soldiers. (...) Ostensibly, as a technique applied to those parts of the photograph that reveal the corporeal truth of war most graphically, such redaction is meant to protect the victims. But it also renders their appearance variable, subject to editorial whim, and pixelization alters not only the appearance of the photograph, but how it signifies. I query whether pixelization offers any meaningful redress for the victims and the extent to which it blunts photography’s capacity to document harm. (shrink)

Previous work in Game Studies has centered on several loci of investigation in seeking to understand virtual gameworlds. First, researchers have scrutinized the concept of the virtual world itself and how it relates to the idea of “the magic circle”. Second, the field has outlined various forms of experienced “presence”. Third, scholarship has noted that the boundaries between the world of everyday life and virtual worlds are porous, and that this fosters a multiplicity of identities as players identify both with (...) themselves-offline and themselves-in-game. Despite widespread agreement that these topics are targets for research, so far those working on these topics do not have mutually agreed-upon framework. Here we draw upon the work of Alfred Schutz to take up this call. We provide a phenomenological framework which can be used to describe the phenomena of interest to Game Studies, as well as open new avenues of inquiry, in a way acceptable and useful to all. This helps to distinguish the core of the field from the supplemental theoretical and critical commitments which characterize diverse approaches within the field. (shrink)

ABSTRACT A robust literature indicates that when people feel that they are expressing and aware of their true selves, they show enhanced psychological health and well-being. This feeling, commonly referred to as authenticity, is therefore a consequential experience. In this paper, we review a program of research focused on the relevance of authenticity for civic engagement. We describe how a virtuous orientation to civic engagement might make civic actions feel more authentic and how the experience of authenticity might help sustain (...) civic behavior. We then discuss the role that education might play in fostering a deeper connection between civic engagement and the subjective experience of authenticity. (shrink)

Current fears of a “reproducibility crisis” have led researchers, sources of scientific funding, and the public to question both the efficacy and trustworthiness of science. Suggested policy changes have been focused on statistical problems, such as p-hacking, and issues of experimental design and execution. However, “reproducibility” is a broad concept that includes a number of issues. Furthermore, reproducibility failures occur even in fields such as mathematics or computer science that do not have statistical problems or issues with experimental design. Most (...) importantly, these proposed policy changes ignore a core feature of the process of scientific inquiry that occurs after reproducibility failures: the integration of conflicting observations and ideas into a coherent theory. Genomic research results and incidental findings with health implications for a research participant are of potential interest not only to the participant, but also to the participant's family. Yet investigators lack guidance on return of results to relatives, including after the participant's death. In this paper, a national working group offers consensus analysis and recommendations, including an ethical framework to guide investigators in managing this challenging issue, before and after the participant's death.

Many research projects rely on human biological materials and some of these projects generate revenue. Recently, it has been argued that investigators have a moral claim to share in the revenue generated by these projects, whereas persons who provide the biological material have no such claim (Truog, Kesselheim, and Joffe 2012). In this paper, we critically analyze this view and offer a positive proposal for why tissue providers have a moral claim to benefit. Focusing on payment as a form of (...) benefit, we argue that research is a joint project and propose a contribution principle for paying participants in those joint projects. We distinguish between contributions that shape a project’s revenue generating properties, grounding a claim to payment, and contributions that fail to ground such a claim. We conclude, contrary to existing arguments and practices, that some tissue providers have a moral claim to payment beyond compensation for risk and burden. This conclusion suggests that investigators, institutions, and sponsors should reconsider the fairness of their current practices. (shrink)

In the WebSurf task, humans forage for videos paying costs in terms of wait times on a time-limited task. A variant of the task in which demands during the wait time were manipulated revealed the role of attention in susceptibility to sunk costs. Consistent with parallel tasks in rodents, previous studies have found that humans preferred shorter delays, but waited longer for more preferred videos, suggesting that they were treating the delays economically. In an Amazon Mechanical Turk sample, we replicated (...) these predicted economic behaviors for a majority of participants. In the lab, participants showed susceptibility to sunk costs in this task, basing their decisions in part on time they have already waited, which we also observed in the subset of the mTurk sample that behaved economically. In another version of the task, we added an attention check to the wait phase of the delay. While that attention check further increased the proportion of subjects with predicted economic behaviors, it also removed the susceptibility to sunk costs. These findings have important implications for understanding how cognitive processes, such as the deployment of attention, are key to driving re-evaluation and susceptibility to sunk costs. (shrink)

In this eloquent collection of essays, Rebecca Martusewicz positions a philosophy of education that relies on what transpires between teachers and learners in various contexts. She thoughtfully analyzes how, in the relationship between teachers and learners, all kinds of ideas, beliefs, interpretations, and meanings are generated as a result of potent generative forces that depend, as she demonstrates using post-structuralist theories, on difference as their fuel. Ultimately she argues that to become educated requires an attention to the welfare of (...) self and others and a willingness to confront and shift one’s own habits, practices, and beliefs for that purpose. This work contains: clear translations of post-structuralist theories such as those of Deleuze, Serres, and Derrida; well-written essays that blend good storytelling, theory, and ethical analysis to reconceptualize education as the means toward social justice; and a clear argument for the drawing together of analyses of difference introduced by post-structuralism with attention to ethics and social justice as they apply to education. Games Studies reveals the performative nature of playing a character in a virtual-game-world (Nitsche 2008, p.205; Pearce 2006, p.1; Taylor 2002, p.48). Tbe Player/Character relationship is typically understood in terms of the player’s in-game “presence” (Boellstorff 2008, p.89; Schroeder 2002, p.6). This gives the appearance that living-into a game-world is an all-or- nothing affair: either the player is “present” in the game-world, or they are not. I argue that, in fact, a constitutive phenomenology reveals the Player/Character relationship to be a (...) multi-dimensional matter of empathy. I advance a broadly Schutzian framework, drawing on his 1932 discussions of “face-to-face encounters” and ”historical predecessors,” showing how at- tention to empathy reveals a variety of “presences” that different kinds of Player/Character relationships afford. The central determinants of empathetic affordances which I focus on here are (i) how much players know about a character (especially the character’s past) and (ii) how players learn this information.The purpose of this discussion will be to show that a phenomenological analysis reveals that the relationship between a player and their character is complex, highly variable, and inherently social. Furthermore, it will add to the growing body of scholarship that demonstrates that video games are rich social objects deserving of study. (shrink)

Biological ontologies are used to organize, curate, and interpret the vast quantities of data arising from biological experiments. While this works well when using a single ontology, integrating multiple ontologies can be problematic, as they are developed independently, which can lead to incompatibilities. The Open Biological and Biomedical Ontologies Foundry was created to address this by facilitating the development, harmonization, application, and sharing of ontologies, guided by a set of overarching principles. One challenge in reaching these goals was that the (...) OBO principles were not originally encoded in a precise fashion, and interpretation was subjective. Here we show how we have addressed this by formally encoding the OBO principles as operational rules and implementing a suite of automated validation checks and a dashboard for objectively evaluating each ontology’s compliance with each principle. This entailed a substantial effort to curate metadata across all ontologies and to coordinate with individual stakeholders. We have applied these checks across the full OBO suite of ontologies, revealing areas where individual ontologies require changes to conform to our principles. Our work demonstrates how a sizable federated community can be organized and evaluated on objective criteria that help improve overall quality and interoperability, which is vital for the sustenance of the OBO project and towards the overall goals of making data FAIR.
